If I file bankrupcy will that automatically stop the foreclosure sale of my house?
March 31st, 2009 | by admin |foreclosure sale set for today at 2pm. heading down to court house to file for backruptcy, this morning.
I live in AZ. and my lender has been lying, cheating…. she even took out a 2nd mortgage on MY HOUSE! we just want to stop the sale so we can show the court what's she's been doing.
I did the credit counselling course over the phone last night, have my printed certificate in hand.
It ALWAYS someone else's fault, isn't it?
SIGH!
NO, it's too late to get out of it now. It's not as easy to file for bankruptcy now as it used to be – for the very reason that people used it as a loophole to deny their own financial responsibility.
Sorry. You're just going to have to face the music on this one.

No. The forclosure process is too far gone! You waited too long. It takes a good couple months for a bankruptcy to be final and you have just plain waited too long for all of this, you will be losing your house, I'm surprised you haven't been locked out of your house yet.

maybe if you filed earlier…if the sale is set for today it could be some complication … either way you should contact a lawyer or ur loan office to get more details instead searching for maybe answers on yahoo! answers….good luck

Just remember. You can only file for bankrupcy, "once" in
every "nine years." Can you make the house payments

Yes. However, you MUST file a Chapter 13 bankruptcy, not a Chapter 7. Chapter 7 will not stop the foreclosure of your home. This case needs to be filed with all the required documents before 2:00 p.m. today.
Make sure you have the petition, all required schedules, all required documents and filing with you.
HOWEVER, check with the clerk of the court and make sure you can file today. In Cook County, Illinois, you must complete the pre-filing credit counseling course at least 24 hours in advance of filing your case.
