			<content:encoded><![CDATA[<p>He arrived in Washington to find the Democrats working with the Bush Administration to pass an unpopular $700 billion bailout.  The Democrats had already cut their deal with Bush.  The Dems agreed to the price tag while Bush agreed to special aid to families facing foreclosure, equity for the taxpayers, and limits on executive compensation.  But no sooner had McCain arrived than he derailed the deal.</p>
<p>Knowing how unpopular the bailout is with the American people, the Democrats are not about to pass anything without broad Republican support even though their majorities permit them to act alone.  Instead of signing on with the Democratic/Bush package, the House Republicans are insisting on replacing the purchase of corporate debt with loans to companies and insurance paid for by the companies, not by the taxpayers.  That, of course, is a popular position.  McCain would be comfortable to debate this issue division all day.  And, if the Dems don’t cave into the Republican position, that’s probably exactly what he’ll do on Friday night’s scheduled debate in Mississippi.</p>
<p>But the Democrats are not about to be stubborn.  They know their package is a lemon and need the political cover of Republican support.  So the Republicans can write their own ticket…and they will.  </p>
<p>These are Dick Morris&#8217;s words not my own (I&#8217;m on his mailing list).  So based on this information, is there any reason that we should have egg on our faces simply because McCain is now attending that debate, as so many liberals seem to think? </p>

<br />No egg at all on anyones face except Bush, Pelosi and Reid and the folks that were trying to force feed that deal down our throats.<br />
The deal was not finished at all.  Most sources indicate the Democrats announced the ill fated deal to preempt McCains arrival.   The deal quickly evaporated before McCain arrived because, as he said, it did not have bipartisan support.  The house Republicans were never going to go along.  They are now working on an alternative plan.<br />
McCain did help move things along.  His presence, unlike Obama&#8217;s, was productive.<br />
McCain was right to give this problem the attention it deserves.<br />
Weather or not the solution will be more than patch work remains to be seen.<br />
Few people have noticed he did not say they would solve the problem overnight.  Pushes to do that are idiotic.  We should not be pushed into socializing the entire mortgage industry.<br />
It&#8217;s now been shown that the deal Bush and the Dem leadership were supporting would also give massive subsidies and a large chunk of potential profits that should go back to tax payers into the hands of ACORN.   Hey, isn&#8217;t that an organization tied to voter fraud, and directly involved in many of the causes of this crisis, and oh yeah Obama and the Dems fingers are all over that supposed &#8220;non-partisan&#8221; organization.</p>

My dilemma is we are now upside down on our  mortgage. We purchased about two years ago and the appraiser appraised the house at 200k. So that&#39;s what we paid the seller. Looking at the comps today my house only appraise at 169k a big difference and I&#39;m wondering what can be done about it? We are not in default nor have we lost a job (thank God) however, I think we are being penalized for something we did not do. To sell my house, which I want to do, we would have to come out of pocket almost 40k. I don&#39;t know about anyone else, but we can&#39;t afford that. Any help out there? <br />Research Short Sales.   You will have to short sale the property, the bank eats the loss, not you.</p>

<p>$650 million for coupons to help consumers convert their TV sets from analog to digital, part of the digital TV conversion.</p>
<p>$600 million to buy a new fleet of cars for federal employees and government departments.</p>
<p>$75 million to fund programs to help people quit smoking.</p>
<p>$21 million to re-sod the National Mall, which suffered heavy use during the Inauguration.</p>
<p>Remember, this economic stimulus bill is supposed to be used as a catalyst to re-start our economy. Period.</p>
<p>$2.25 billion for national parks. This item has sparked calls for an investigation, because the chief lobbyist of the National Parks Association is the son of Rep. David R. Obey, D-Wisc. The $2,25 billion is about equal to the National Park Service’s entire annual budget. The Washington Times reports it is a threefold increase over what was originally proposed for parks in the stimulus bill. Obey is chairman of the House Appropriations Committee.</p>
<p>$335 million for treatment and prevention of sexually transmitted diseases.</p>
<p>$50 million for the National Endowment for the Arts. $4.19 billion to stave off foreclosures via the Neighborhood Stabilization Program. The bill allows nonprofits to compete with cities and states for $3.44 billion of the money, which means a substantial amount of it will be captured by ACORN, the controversial activist group currently under federal investigation for vote fraud. Another $750 million would be exclusively reserved for nonprofits such as ACORN – meaning cities and states are barred from receiving that money. Sen. David Vitter, R-La., charges the money could appear to be a “payoff” for the partisan political activities community groups in the last election cycle.</p>
<p>$44 million to renovate the headquarters building of the Agriculture Department.</p>
<p>Remember, this economic stimulus bill is supposed to be used as a catalyst to re-start our economy. Period.</p>
<p>$32 billion for a “smart electricity grid to minimize waste.</p>
<p>$87 billion of Medicaid funds, to aid states.</p>
<p>$53.4 billion for science facilities, high speed Internet, and miscellaneous energy and environmental programs.</p>
<p>Remember, this economic stimulus bill is supposed to be used as a catalyst to re-start our economy. Period.</p>
<p>$13 billion to repair and weatherize public housing, help the homeless, repair <a href="http://www.bestforeclosurenews.com" target=_self>foreclosed homes</a>.</p>
<p>$20 billion for quicker depreciation and write-offs for equipment.</p>
<p>$10.3 billion for tax credits to help families defray the cost of college tuition.</p>
<p>$20 billion over five years for an expanded food stamp program.</p>
<p>Remember, this economic stimulus bill is supposed to be used as a catalyst to re-start our economy. Period.</p>

<p>$2 billion earmark to re-start FutureGen, a near-zero emissions coal power plant in Illinois that the Dept. of Energy defunded last year because the project was inefficient</p>
<p>$650 million for the digital television (DTV) converter coupon program</p>
<p>$88 million for the Coast Guard to design a new polar icebreaker (ship)</p>
<p>$448 million for constructing the Dept. of Homeland Security HQ</p>
<p>$248 million for furniture at the new Homeland Security headquarters</p>
<p>$600 million to buy hybrid vehicles for federal employees</p>
<p>$400 million for the CDC to screen and prevent STD’s</p>
<p>$1.4 billion for a rural waste disposal programs</p>
<p>$125 million for the Washington, D.C. sewer system</p>
<p>$150 million for Smithsonian museum facilities</p>
<p>$1 billion for the 2010 Census, projected cost overrun of $3 billion</p>
<p>$75 million for “smoking cessation activities”</p>
<p>$200 million for public computer centers at community colleges</p>
<p>$75 million for salaries of employees at the FBI</p>

My question is this:  Lets say your mortgage is due the 15th of each month and you have a grace period until the 24th.  Does foreclosure happen on the due date or day after the grace period? I did research and my state, Mississippi, has 60 days.  What date does foreclosure happen?  Trying to get my ducks in a row, or at least try.<br />
I had to give an update: I called a HUD certified credit counseling organization.  They lifted a weight off my shoulders.  The mortgage company can&#39;t forclose on us for us being 2 months behind on our mortgage.  We called my mortgage company and all I have to do is pay 10.72 to get it up do date.  I felt better with this organization on the same line with me.    It was to the point that I was completely sick. Hopefully this won&#39;t happen again to us but just in case, I have that organizations number in my phone book.  I feel better knowing the full process of foreclosure that this lady explained to me. So if anybody out there is having problems and being harassed by a mortgager, email me and I will give you their phone number.  They were absolutely wonderful!!!<br />
<br />The first start toward a foreclosure is The current lender filing a Notice of Default.  After you have been 90 days delinquent on your home, this is a document recorded with the county.  During that time, if you come up with the past due mortgage payments you can save your home.  When you start getting 120 days past due, it&#39;s most likely too late and your house is in foreclosure.  </p>
<p>In reference to a grace period on paying your mortgage every month:</p>
<p>   Your mortgage is due the 1st of every month.   You have a grace period to make that payment up until the 15th.  If you pay your mortgage payment after the 15th, you will incur a late charge.  You will not show delinquent or past due on your credit report until after you are 30 days late.</p>

<br />Being on the deed doesn&#39;t affect you in this situation. As long as he is the only one listed on the mortgage and you divorced prior to the house going into foreclosure, Federal Law prohibits a creditor from including you in the bureau notices as you aren&#39;t a party to your ex-husband&#39;s finances anymore.</p>
<p>However, having said that, my suggestion would be to monitor your credit reports in the weeks after foreclosure. Mistakes can happen, and it&#39;s better to fix a mistake like a foreclosure that you weren&#39;t a party to, prior to applying for a loan, rather than going through a denial notice and having to fix it at a later date before reapplying for that loan you wanted.</p>

We had a contract in the begininning stating that he was responsible for ALL damages since he was only sending money to the mortgage company and I was making nothing. Recently he left without telling me, after I told him he had to resign the lease or get out, and everything was destroyed or gone. We had a $5000 pool that is missing, there were holes in every room, our new carpets were cut and had stuff all over them, all the windows were spray painted. Insurance won&#39;t help me and I come to find out that my house is in the process of foreclosure because he hasn&#39;t even been paying the mortgage. I would like to sue for how much we would have sold the house for plus a bit more because it was our home but no lawyers are willing to help me. How can I file a claim in the state of MS without a lawyer? I am losing everything because of these people and everyone is telling me there is nothing I can do.<br />
Insurance did respond and after two months said they were not going to do anything. They found every reason in  the book to not pay out and I have filed a claim with MS department of Insurance. I did get the letters of foreclosure and tried everything in my power to save the house but can not afford rent and the mortgage and can&#39;t get anyone to make my brother in law pay his past mortgage plus the month he moved out. I did keep up with it but he kept promising he would pay it as soon as he got his bonus and I kept listening like an idiot. I applied for HUD assistance but they advised me that because I can&#39;t live in the house (because it is not livable), they could not save it. I am not saying that I was not stupid to have trusted someone because they were family but it doesn&#39;t mean that they should get away with it.<br />
I filed a police report but they filed it as a civil matter because we knew them and were allowing them to stay in the house. However I do have the report. I did that right away.<br />
<br />You need a lawyer BAD.  If you can&#39;t afford one, there are government lawyers who can help you just need to look into that matter in your local government.</p>
<p>You can take someone to court without a lawyer but it&#39;s tough.  I&#39;ve done it in small claims court but that&#39;s too small for your needs.  You need a full blown lawyer in a normal court.</p>

<br />First, check with your local county office to see what permits you may need. If you do remodeling without a permit it can be red tagged. You as the legal homeowner can be your own contractor and do any repairs that do not require inspection. If you hire a remodel contractor for the electrical, plumbing, etc, make sure they are able to pull the permits for that and only used licensed individuals for this work so you can get insurance on the home without problems. Keep in mind that electrical and plumbing work is less expensive if you do the demo work first and then let them run their lines, etc. Best of luck.</p>

We made a $5000 deposit that was supposed to go toward the downpayment on the home. We found out last week that the builder is going into foreclosure (process started 4 monts ago) and the house will go to auction 3/6/09. My husband and I have decided that we no longer want to deal with this and want to pack up and leave. Will we be penalized for this even if the builder will no longer owns the home? Also do we have any rights to get out deposit back (we are in the state of Mississippi)?</p>

<br />You need a lawyer to review your documents and see if you can recover your $5k.</p>
<p>Since the house is being sold at auction, you might need to consider that your money is gone.</p>
<p>If in your shoes I would pack up the bulk of my stuff, but stay right where you are at.  If you want any hope of recovering your deposit, I would not leave until forced to.</p>
<p>But for goodness sake go and consult with a lawyer or two and find out what if anything you can do.</p>

The statue of limitations show 3 years in our state. Has collection agency trying to collect on the debt. If the statue of limitations is 3 years, is it legal to continue to call and get the payment? Can they keep re-selling the debt and start all over with the collections process.  Mississippi statue of limitations show this on their website&#8230;<br />
Open Accounts: 3 years from the date at which time the items on the account became due and payable,(MCA 15-1-29 &#038; MCA 15-1-31).  Can they still contact him to collect it??<br />

<br />The foreclosure already went to court, well under the SOL.   The SOL does not mean that debts are forgiven, only that they can no longer be sued for.   They are not sueing him, they are collecting on a debt that already went to court.</p>
<p>He will be obligated to pay this until he has done so and it is completely legal for them to attempt to collect the money owed until he has taken care of it.</p>

			<content:encoded><![CDATA[<p>There were two mortgages on the property.  The 1st mortgage was behind one month and the 2nd mortage was behind several months.  Onwer was working with the mortgage company to arrange payment plan.  Apparently mortgage company dicided to foreclose while still working to resolve the late payments.  Found out that house was foreclosed only when the buyer of the foreclosure asked family to vacate property.  It appears that the morgage company may have been misleading them while putting the foreclosure in process.  Is there any legal recourse that can be taken against the martgage company?<br />
<br />I think the person you&#39;re trying to help is &quot;sugar-coating&quot; the situation.  It usually takes several months to foreclose on a house.  They were probably at least 6 months behind on one or both mortgages.  Forclosures require that a notice be posted on the house, and that the auciton is advertised in the newspaper of record&#8230;it should not have been a &#39;surprise&#39;.  You&#39;ll need an attorney to review the situation to find any recourse&#8230;if it exists.</p>
